Medicaid "Community Spouses" May Keep More Money in 2008

 
     
   
   
   

The "Community Spouse Resource Allowance" was established under the Deficit Reduction Act to ensure that Medicaid residents' spouses have the minimum support they need to continue to live in the community. In 2008 the maximum amount of assets the "community spouse" of a Texas nursing home resident receiving Medicaid may keep will increase from $101,640 to $104,400.

The spouse will be allowed to keep the first $20,880 in assets in 2008 (this is an increase from $20,328 in 2007), even if this is more than half of the couple's assets.

The "Community Spouse Resource Allowance" sets the maximum amount that any state may allow a community spouse to retain without a hearing or a court order. If you are interested in increasing the amount available to a community spouse, please first consult with an elder law attorney who is very familiar with Texas Medicaid law. Mistakes are harder and more expensive to fix than getting good advice up front.
